CEMETERY OPEN 365 DAYS
8:00 A.M. TO 5:00 P.M.
1. The Superintendent has general charge of the grounds, under the supervision of the Grounds Committee.
2. No internment/inurnment in the grounds of the Cemetery will be permitted unless the Superintendent shall have given written permission authorizing same.
3. No interment/inurnment will be permitted until lot and interment fee are paid in full.
4. All lots shall be held under the provision of the Act of the General Assembly of North Carolina entitled “An Act to Incorporate the Proprietors of the Wilmington Cemetery” ratified 27th December 1852, as amended and said lots shall not be used for any purpose other than as a place of the burial of the dead.
5. No lot owner shall allow interments to be made on his lot for a remuneration or compensation, nor shall any transfer or assignment of any lot or of any interment therein be valid without the approval of the President of the Company.
6. If any tree or shrub in any lot shall in any way become detrimental to an adjoining lot or to any avenue, path or walk or become unsightly, dangerous or inconvenient, it shall be the duty of the Superintendent to remove or remedy the same.
7. If any monument, effigy or enclosure on any structure, whatever, or inscription be placed in or upon any lot, which shall be considered by the President and Directors of the Company as offensive or improper, injurious to the surrounding lots or grounds, the President and Directors shall have the right and it shall be their duty, to cause such offensive or injurious objects to be removed.
8. All vaults to be constructed, lots to be enclosed and monuments to be erected and all other improvements on the lots shall be subject to the control or direction of the Superintendent.
9. The President and Directors of the Company shall from time to time lay out and alter such avenues and paths in the grounds of the Cemetery and make such rules and regulations for the government of such grounds generally, as they may deem requisite and proper to secure and promote the general interest of the Cemetery.
10. Sprinkler systems, hose, etc., must not be used for more than one hour at any one time or left running when the lot owner or his/her representative is not present.
11. Flowers, wreaths, funeral designs and flags will be removed from graves when, in the judgment of the Superintendent, they have become unsightly. Seasonal arrangements for Christmas and Easter holidays will be removed one month after holiday.
12. Debris that is cleared by lot owners shall be placed at the roadside as to not interfere with traffic passage.
13. Bicycles and motorcycles are not permitted within the Cemetery grounds.
16. Dogs must be leashed in accordance with City Ordinance.
(Applies to all sections of the cemetery)
1. Only one interment is permitted in each adult burial space unless the owner of the lot purchases additional rights of interments.
2. Up to four cremation interments are allowed per adult burial space subject to the requirement that the owner purchase additional burial rights as set forth in paragraph #17 above.
3. Where a burial space contains an existing casket or vault, up to four cremation interments are allowed in addition to the existing casket or vault provided that the Superintendent has determined that such additional interments can be placed on the burial space.
4. Only two grass markers (flat) will be allowed per adult burial space and must be similar in material with surrounding monuments in that section of the cemetery.
5. The disposition of cremated human remains (cremains) shall require the same authorizations as regular casket interments.
6. Burial of cremains in ground spaces, whether in regular burial spaces or special areas set aside for ground cremation burial, shall require use of a sealed, non-biodegradable, non-collapsible urn or urn vault except as provided in paragraph # 23.
7. If burial of cremains without a container into a grave is desired, authorization must be signed by the burial space owner and approved by the Superintendent prior to burial waiving any future removal of those cremains.
8. Any person who deposits cremains at a grave site without the prior written permission of the Superintendent and without paying the required fees shall be required to pay the current fee for cremation burials plus a fine equal to 25% of the current fee for cremation burials.
1. The owner of each lot shall have the right to enclose the same with a wall not exceeding two and a half feet in height above the surface of the ground or with a railing or fence to be placed on the lines and within the limits of his lot. If any such wall, railing or fence shall become so broken or defaced as in the opinion of the President and Directors of the Company, to be unsightly or offensive, they may cause the same to be removed, unless the owner of said lot, shall upon notice, renew or repair the same.
2. Every lot owner shall have the right to erect within his lot any proper stones, monuments or sepulchral structures and to cultivate trees, shrubs, and plants within the same, and under the direction of the Superintendent, subject to the provisions of paragraph 7 above. No tree growing within any lot shall be cut down or destroyed without the consent of the President and Directors.
1. All head stones must be placed at the head of lots; other markers must be level with the ground.
2 Planting will be permitted at head of lot for a distance of four feet towards foot of lot while grave/grass area to remain flat.
3. Coping, retaining walls, etc., must be built within boundaries of a lot and must not extend above ground level.
4. Potted plants, cut flowers and wreaths will be allowed at all times on the lot but may be removed if they become unsightly at the direction of the Superintendent.
5. All tree planting will be under the supervision of the Superintendent.
6. No double burials (one on top of another) will be permitted.
7. No brick graves will be permitted in this Section.
1. All headstones must be placed at the head of lots; other markers must be level with the ground.
2. Bronze markers are not permitted.
3. All coping to be built within lot boundaries and must consist of marble, granite, or concrete and be flush with the ground.
4. No tree planting will be allowed; planting of shrubs will be permitted under the supervision of the Superintendent.
5. No double burials (one on top of another) will be permitted; no brick graves allowed.
1. Every lot owner shall have the right to place within his or her lot a monument not exceeding four feet in height with the foundation of the monument to be level with the ground, depending on the type of monument and subject to the prior approval of the Superintendent. All additional markers and posts used to mark off lots shall be level with the ground, permitting lawn mowers to pass over and near without marring the markers. No coping, chains or any obstruction will be permitted for marking lots; only corner posts not over six inches square are permitted.
2. No mounds or other obstruction interfering with the operation of mowers will be permitted.
3. No planting of any kind will be allowed on the lots, and flowers when supplied must be placed in removable vases or other removable lightweight receptacles that will not interfere with the proper cleaning of the lots.
4. If any enclosure or structure, mound or anything in violation of the foregoing resolutions or the intent thereof is encountered, it shall be the duty of the Superintendent to remove the same.
5. Any underground vault type of graves, or other forms of burial of the dead, shall be subject to the control of the Superintendent, acting on the authority of the President and Board of Directors.
6. No double burials (one on top of another) will be permitted.
7. No brick graves will be permitted in this Section.
1. The marking of graves is restricted to flat bronze tablets of such dimensions, materials and construction as approved by the President and Directors and no marker or memorial (referred to herein as a “memorial” shall be placed without the approval of the Superintendent.
2. Only one memorial is permitted on an individual grave. Memorials for the graves at the top of the lot shall be placed two feet from the top boundary line; memorials for the graves at the bottom of the lot shall be placed six and one-half (6-1/2) feet below the bottom edge of the upper marker and in line with it.
3. All family memorials shall be placed at the top of the lot, two feet from the top boundary line, and centered from the sides. A family memorial may be used for two or more adjoining lots and centered equidistant from the outer boundary lines.
4. Each casting shall be true, free from all weakening defects; also free from minor defects which are visible from a distance of three feet.
5. All lettering, numerals, ornamentation, etc., must be hard chased, finely buffed and highlighted. Backgrounds shall be of sculptured texture (sample on display at Cemetery office) and no painted or pigmented lacquer finishes will be permitted.
6. Each memorial shall be cast with four or more bosses on the back, drilled and tapped to receive 3/8 inch anchor lugs of brass or bronze from 4” to 6” in length, anchor lugs to be supplied with the marker. Such marker shall be set on a proper size of granite to protect the marker from equipment.
7. Family memorials shall not exceed 48” x 18” and individual memorials 24” x 14”. The Cemetery reserves the right to amend these size requirements at any time and for any reason deemed appropriate by the President and Board of Directors.
8. All memorials shall be flush with the ground and no marker or object of any kind will be permitted on any lot in this Section which does not meet the requirements as set forth in these rules.
9. All memorials shall be set by the Cemetery. Charges for this service may be obtained at the Cemetery office.
10. No planting of any kind will be permitted on the lots in this Section and flowers, when supplied, must be placed in removable vases or other removable lightweight receptacles that will not interfere with the proper care of the lots.
11. No double burials (one on top of another) will be permitted in this Section.
12. No brick graves will be permitted in this Section.
